AELB clarifies on Lynas waste


The Atomic Energy Licensing Board says that Lynas is legally compelled to get rid of waste generated at its Pahang-based plant.
PETALING JAYA: Rare earth mining company Lynas Corporation Ltd, according to the Atomic Energy Licensing Board (AELB), will be legally required to get rid of any residue that comes out of its Gebeng plant.
The AELB clarified this in response to media reports that Lynas was not legally bound to remove its waste, after it was granted a Temporary Operating Licence (TOL) for the Pahang-based plant.
It said that Lynas’s first TOL – approved on Jan 30 2012, but never issued – was subject to several conditions, including the removal of residue.
“Subsequently, Lynas had submitted two letters of undertaking, the first by Lynas Australia committing itself to remove the residue out of Malaysia,” AELB said, adding that Lynas’s Malaysia office shared the same view.
It said that all the conditions applied to Lynas’s TOL then still applied, even after additional requirements were added by the Ministry of Science, Technology and Innovations (MOSTI).
A second TOL was issued by the AELB earlier this week, and will expire on Sept 2, 2014.
“The management and removal of residue is an integral part of the TOL’s conditions and agreements, and permanently documented in the licence document issued to Lynas,” the AELB said.
